A Friendly Copyright Reminder

This forum seems unique because we like to share recipes, but unfortunately, in most cases, those recipes are copyrighted. Because we don't want to infringe on someone's copyright, when you share a recipe, please share it as a link to an online recipe or re-write the recipe in your own words before posting it. Photos of recipes from copyrighted cookbooks will be removed and will need to be replaced with a recipe written in your own words or a link found online to that recipe. Recipes which have been copied and pasted from online sites will also be removed and need to be replaced with either a link to the online recipe or be re-written in your own words.

I've looked into this topic and basically recipes can't have a copyright, but creative descriptions in the directions can be copyrighted. Basic directions are fine to copy, but add your own flair and anecdotes.

I wonder though, wouldn't it be okay to copy a page with a photo if you are giving reference to the original source, much like you would in a an academic paper?

I've reviewed the copyright notices in quite a few of my cookbooks and they all say that they cannot be reproduced in any form except by express written permission of the author.

Maybe they say that, but it’s not the law. I helped on a church cookbook committee, and one of the ladies on our committee has co-written three cookbooks. She was the first to explain copyright laws to me about recipes, and a quick on-line search confirms what she said. I also think that as long as the source is acknowledged, it should be fine. I don’t need to argue though. I rarely share recipes because of the mixed feelings on this issue.

The copyright rules of this forum might be stricter then the law requires, but we enforce them anyway. ;)

Re: A Friendly Copyright Reminder

I can see that it's a gray area after researching it. But I agree that our GCM rules would supersede those. I'll post GCM's copyright rule for reference:

6. No posting copyrighted materials to the board—brief excerpts allowed, except do not post posts from other message boards, from mailing lists, from blogs, or from Facebook pages (see our copyright policy).
Policy for Posting Copyrighted Materials to the Board

Please do not post copyrighted material—this includes articles, poems, etc—to the board unless one or more of the following is true (and if any of these are the case, please note so along with the material you are posting):

1) you own the copyright
2) it clearly states that it is public domain
3) it says it may be freely copied
4) you have permission from the copyright holder to post it to the board. If you have received permission to print/reproduce it, please include that in your post.

If one of the above is not true, you may post an excerpt from the material. Please follow these guidelines:

1) Your excerpt should be approximately 100 words or less (please post a shorter excerpt if it is a poem or short article) .
2) When posting excerpts from materials online, please include a link to where it can be read online.

Do not post posts from other message boards, mailing lists, blogs, or from Facebook pages.

Thanks for the GCM rule reminder. :) I have a History degree and my initial frame of reference is about citing sources so credit is given where it’s due...but obviously the GCM rules supercede academia and law here.

We do totally require giving credit, linking to the original post or citing the source. But netiquette frowns upon just taking content.

I think it's a good idea to err on the side of caution. It's easy enough to put the directions into our own words. Most recipes are too verbose, IMO, anyway. :giggle The list of ingredients has never been an issue, as far as I know. You can copy the ingredients without any concern.
